Claim No 3. S. Kaapuiki March 18th. Kiaimoku _ Witness deposed that Kuihelani was Governor of Oahu immediately after it was conquered by Kamehameha & that he lived with the following persons: Manuhoa, Kaihekioi, Koki, Kalaikuahulu, Eka, Piipii, Manini, Aikaki, & Kamakaokalani; Also Kekauluohi, Pauahi, and Kalainohino, on lands called, Kikihale, Hukolo; Kuihelani being their Landlord; but Kamehameha the true owner. Nalimaapa was a servant of Kuihelani and lived there with his Master. He died about the time this fort was built. While Kamehameha was at Hawaii. Kuihelani died & left his right to his son. Kawailepolepo & Kaihekalai then took charge of the place instead of Nalimaapa. But Kaikekahi was turned away by Kawai- lepolepo[Kawailepolepo] at Kamehameha's orders; and Mahoe was put in his place. Kalaimoku at the time of building the Fort was offended with Mahoe & displaced him; giving char[?][charge] to Kaumaumakea, He returned charge until Manu[?] W 1 [Text in Margin: Register P 9, Kiaimoku] 10 took charge of the Fort; when Kaumaumakea was replaced and charge given to Pehu, though Kaumau[?] continued to live as he had done. But at the time [?] Kuakini took charge of the fort, Kaumaumakea his right to Auwae; but when Auwae went to Maui then Boki took it as Governor & there being no[?] -pant, moved Kaahumanu's house to that place. At Kikihale Kaapuiki has a little place, but [?] a small part of that Land; and has always been possession of it since the death of Nalimaapa. Testimony resumed Page 11-13. Claim No 3 S. Kaapuiki confirmed fr.P.10 April 1st. Paahana _ sworn _ deposed that he was born on Hawaii; & came to this Island when it was conquered by Kamehameha. Witness was small at that time; but as soon as he was old [Text in Margin: Register P 9, [?]ana] 12 enough to become intelligent, he was acquainted with the land which Kaapuiki now claims. Kamehameha gave the land to Kuihelani _ indeed Kuihelani was the head man of all Honolulu. Witness is own Brother to Kaapuiki the claimant. He lived there with his Father as servants of Kuihelani. The yard was occupied by us in connection with Hikiau who was the head man under Kuihelani; there were other servants in the yard belonging to Kuihelani. Kuihelani died suddenly without a will. Mahai was appointed to his office; & we then lived under him as Kuihelani. We lived at Kikihale. Subsequently Mahai was dispossessed. Kawailepolepo was appointed in his place. When Rihoriho came to this Island, the Chiefs & people filled up the place; at which time, I with some of the rest of us, moved back to Palama, and left our yard with my grandmother & others of my relations. Kaapuiki was at this time a child & stayed with his grandmother, at which place he has always lived to the present time. (resumed Page 20 W 113 20 Claim No 3. Kaapuiki. continued fr. Pge. 12. April 22. Paahana _ sworn _ deposed _ the small yard occupied at present by claimant. has been in his possession from the time Rihoriho the arrived at this Island. It was first surrounded by a fence, when the roads were laid out. Witness says Claimant has never been opposed in his possession from his earliest pos- -session. Witness says there is another yard adjoining - now occupied by Kaniau, which was occupied & surrounded at the same time with the above; Kawailepolepo was the oc- -cupant [occupant] and owner; and I now belong to the daughter of Kawailepolepo; in whose name & for whom, Kaapuiki claims it. That yard has been in their undisturbed posses- -sion[possession] from time of Rihoriho. Kaapuiki _ Claimant remarked. that he claims the place where he now lives, in his own name, and own right, and he claims the other in the name of Mileka Keomailani and for her; he being her guardian as appears by Papers presented. John II Sworn _ deposed, that after the death of Kameha- -meha [Kamehameha], Kawailepolepo, the Son & heir of Kuihelani, (illegible) guilty of Murder, and therefore all the chiefs agreed that the whole of his lands should be forfeited, which was [?] W [?] 2 [Text in Margin: Register P 9, Paahana, Kaapuiki, John II]
